Terms of Service

These Terms of Service ("Terms") govern your use of www.propmgmt.com and the tenant maintenance request portal (collectively, the "Service") operated by Lee Cleveland Select Management LLC ("LCSM," "we," "us," or "our"). By accessing or using the Service you agree to these Terms.

1. Eligibility and Account Use

The Service is intended for commercial tenants of properties managed by LCSM and for authorized LCSM staff. You must be at least 18 years old. You agree to provide accurate information and to keep your contact details current. You are responsible for activity on any login credentials issued to you.

2. Maintenance Requests

The Service allows tenants to submit maintenance requests, attach photos, and receive updates by email and (if you opt in) SMS text message. Submission of a request does not guarantee a specific response time. Emergency conditions (gas leaks, active fires, flooding, no heat in winter, life-safety issues) should be reported by phone to LCSM at (216) 559-9090 or, if applicable, to 911 or the local utility, not through the portal.

3. SMS Messaging Terms

By providing your mobile phone number and checking the SMS consent box on the maintenance request form, you expressly consent to receive SMS text messages from Lee Cleveland Select Management LLC at the number you provided about your maintenance request.

Program description

Program name: LCSM Tenant Portal
Purpose: Confirmations, status updates and follow-up questions related to maintenance requests you submit.
Message frequency: Varies based on the activity of your request. Typical volume is 2 to 6 messages per request.

Costs

Message and data rates may apply. Your mobile carrier may charge for messages received or sent. Check your mobile plan for details. LCSM does not charge for SMS messages sent through this program.

How to opt out

You may opt out at any time by replying STOP, STOPALL, UNSUBSCRIBE, CANCEL, END or QUIT to any SMS message from us. You will receive one confirmation message and no further messages. To resume messages, reply START or submit a new maintenance request and opt in again.

Carriers and disclaimers

Supported carriers include all major US carriers. Carriers are not liable for delayed or undelivered messages. We are not responsible for messaging delays attributable to carrier networks.

Privacy

SMS opt-in data and consent will not be shared with any third party for marketing purposes. See our Privacy Policy for full details on how we handle your information.

4. Acceptable Use

You agree not to:

Submit false, misleading or fraudulent requests.
Use the Service to harass, threaten or abuse any person.
Upload content that is illegal, defamatory or infringing.
Attempt to gain unauthorized access to the Service or any account.
Use automated means to access the Service except as expressly permitted.

5. Intellectual Property

All content on the Service, including text, graphics, logos and software, is owned by or licensed to LCSM and is protected by copyright, trademark and other laws. You may not copy, modify or distribute Service content except as expressly permitted.

6. Tenant Lease Relationship

Use of the Service does not modify, replace or supersede the terms of any lease or rental agreement between you and the property owner or LCSM. In the event of any conflict, the terms of your lease govern.

7. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. LCSM does not warrant that the Service will be uninterrupted, error-free or secure.

8. Limitation of Liability

To the maximum extent permitted by law, LCSM and its affiliates, officers, employees and agents shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, arising out of or in connection with your use of the Service. LCSM's total liability for any claim arising out of these Terms shall not exceed one hundred dollars ($100).

9. Indemnification

You agree to indemnify and hold harmless LCSM from any claim or demand, including reasonable attorneys' fees, arising out of your use of the Service or your violation of these Terms.

10. Termination

We may suspend or terminate your access to the Service at any time for any reason, including violation of these Terms. You may stop using the Service at any time.

11. Governing Law

These Terms are governed by the laws of the State of Ohio, without regard to its conflict of law principles. Any disputes shall be resolved exclusively in the state or federal courts located in Cuyahoga County, Ohio.

12. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent revision. Continued use of the Service after changes constitutes acceptance of the revised Terms.
